1. Introduction
These Terms and Conditions (“Terms”) govern all access to and use of the website nottinghamroadmeats.co.za and all orders for meat and related products placed through it.
By using our website, placing an order or creating an account, you agree to be bound by these Terms, the Privacy Policy and our Refund and Return Policy.
If you do not agree, do not use the website or place orders.
2. Legal capacity
You confirm that:
- You are 18 years or older and have full legal capacity to enter into a binding agreement; or
- If you are under 18, you are using the site with the supervision of a parent/guardian who accepts these Terms on your behalf.
We may cancel any order if we reasonably suspect that this is not the case.
3. Company details
Nottingham Road Meats (Pty) Ltd
Email:hello@nottinghamroadmeats.co.za
We operate in South Africa and comply with, among others, the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Consumer Protection Act 68 of 2008 (CPA) where applicable.
4. Use of the website
You must not:
- Use the website for any unlawful purpose.
- Try to gain unauthorised access to our systems.
- Interfere with the proper functioning of the website.
- Scrape or copy content or pricing for commercial use without our written consent.
We may suspend or terminate your access if you breach these Terms.
5. Products – meat and related goods
We sell meat and related products, which are perishable goods. By ordering, you acknowledge and accept that:
- Meat is a natural product; colour, marbling, fat coverage and exact weight may vary within reasonable and industry-standard tolerances.
- You must refrigerate or freeze meat promptly upon delivery and cook it thoroughly.
- We are not responsible for any spoilage or health issues caused by your failure to store or cook the products correctly.
Box schemes and carcass share orders (half/quarter animal, bulk boxes)
- Nature of box scheme orders
- Some products are sold as box schemes or carcass shares (for example: half or quarter animal, mixed meat boxes, bulk packs).
- These orders are planned and slaughtered specifically against customer demand, with cutting and packing instructions based on your preferences.
- Estimated weights and variation
- All weights shown for half/quarter animals and box schemes are estimates only.
- Actual carcass size and cut-by-cut weight can vary due to breed, age, fat cover and trimming.
- We aim to stay within a reasonable industry tolerance. Where the final weight is:
- Less than the estimate: we may refund the difference or add extra suitable product;
- More than the estimate: we will not charge extra above the price you agreed at checkout unless clearly stated and agreed beforehand.
- Cutting instructions and default specs
- Where possible, you may give cutting and packing instructions (for example: thickness of steaks, size of roasts, mince vs stewing meat).
- If you do not provide instructions by the deadline we give (for example, [X] days before slaughter), we will use our standard cutting specification for that box or carcass share.
- Once slaughter and cutting have started, cutting instructions cannot be changed for that order.
- Substitutions
- We try to follow the illustrated or listed composition of each box scheme (e.g. approximate number of steaks, packs of mince, roasts).
- Because we work with whole animals, we may substitute cuts of similar type and value (for example, swapping some stewing beef with similar braising cuts), while keeping the overall value of the box at least equivalent.
- We will not deliberately downgrade you to cheaper product types without your consent; where we cannot avoid doing so, we will apply a fair price adjustment or extra quantity.
- Timing and availability
- Box schemes and carcass share orders may be tied to specific slaughter and delivery dates.
- If we cannot fulfil your box scheme on the indicated date (for example due to abattoir issues, animal availability or logistics problems), we will:
- Offer a new date, or
- Offer a full refund, at your choice.
- Interaction with our 10-day refund policy
- Box schemes and carcass share orders are still covered by our 10-day full refund promise, as well as your normal rights under consumer law.
- Because these orders are slaughtered and packed specifically for you, any returns or cancellations after slaughter will normally mean we must collect the products from you or instruct safe disposal, and we will handle the meat in line with food safety rules.
6. Ordering process
- You select products and add them to your cart.
- You proceed to checkout and provide required details (delivery address, contact, payment).
- You confirm the order and make payment in full.
- We send you an order confirmation email. This is not our acceptance of your order, but an acknowledgement that we received it.
- Our acceptance occurs when we process payment and start fulfilling the order (including arranging slaughter and packing based on your order).
We reserve the right to refuse or cancel an order for valid reasons, including lack of stock, incorrect pricing, or suspicion of fraud.
7. Pre-payment and slaughter
- Our products are prepaid so that animals can be slaughtered and processed specifically against orders.
- Once your payment is confirmed, we may proceed to slaughter and/or allocate stock to you.
- Despite this, we still honour our 10-day full refund policy as set out in the Refund and Return Policy, subject to its conditions and to applicable law.
8. Pricing and payment
- All prices on the website are in South African Rand (ZAR) and include VAT where applicable.
- We do our best to ensure correct pricing, but errors may occur. If we discover a serious pricing error after you order, we may cancel the order and refund you in full.
- We may change prices at any time without notice, but changes will not affect orders already paid for.
- Payment methods are listed at checkout (for example, card payments or other approved gateways).
ECTA requires clear disclosure of total prices and supplier information; we display all compulsory charges before checkout as far as reasonably possible.
9. Delivery
- We deliver only to areas specified on our website or during checkout.
- Delivery dates/times are estimates, not guarantees. We try to deliver on or before the indicated date.
- Risk (loss or damage) and responsibility for the products pass to you on delivery to the address you provided, or to any person present at that address who accepts the delivery.
- You must inspect the order on delivery and report visible issues to us as soon as reasonably possible.
If no one is available to accept delivery at the specified time and address, we may:
- Attempt a re-delivery at your cost; or
- Cancel the order and refund you (less delivery and reasonable handling costs), depending on the condition of the goods and our discretion.
10. Returns, refunds and cooling-off
Our detailed rules are in the Refund and Return Policy, which forms part of these Terms.
You have, at minimum, the rights provided under the CPA and ECTA (including the cooling-off rights for certain electronic transactions and rights relating to defective or unsafe goods).
Where our Policy is more generous (for example our 10-day refund promise), the more favourable terms apply.
11. Warranties and liability
- We warrant that products will comply with applicable South African food safety and labelling laws at the time of delivery.
- To the maximum extent permitted by law, we exclude all implied warranties that are not mandated by the CPA or other applicable law.
- Our liability to you for any claim (whether in contract, delict or otherwise) is limited to the amount you actually paid for the order giving rise to the claim, unless the law prevents such limitation.
Nothing in these Terms limits or excludes any rights you have under the CPA or any liability we cannot limit or exclude under law.
12. Customer account
You’re responsible for:
- Keeping your login details confidential.
- All activities that occur under your account.
If you suspect unauthorised use, you must notify us immediately.
We may suspend or close accounts that are misused or that we reasonably suspect are being used fraudulently or in breach of these Terms.
13. Intellectual property
All content on the website (text, images, logos, designs, and software) is owned by or licensed to Nottingham Road Meats and is protected by intellectual property laws.
You may not copy, reproduce, modify, distribute or use any content for commercial purposes without our prior written consent.
14. Changes to the website or these Terms
We may update the website and these Terms from time to time.
- The version posted on the website at the time you place your order applies to that order.
- By continuing to use the website after changes, you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa.
If there is a dispute:
- You must first contact us and give us a reasonable opportunity to resolve the complaint.
- If we cannot resolve it, you may refer it to:
- The Consumer Goods and Services Ombud (CGSO); and/or
- A court with appropriate jurisdiction in South Africa.
16. Contact details for legal issues
For any legal notices or complaints under these Terms:
- Email: hello@nottinghamroadmeats.co.za
